Yes, actually, there is – but it’s still an important part of getting married, even if it’s not much fun! M arriage is a formal and legal declaration, which doesn’t make it sound very romantic and that’s probably one of the reasons it’s so often left to the last minute. Signing a document and linking yourselves together feels to some like dotting the i’s and crossing the t’s, but it can and will hold up in a court of law if anything happens later down the line. This will also mean a lot of frustrating little changes surrounding name changes, especially if you need to update your bank accounts and any subscriptions or major legal documents (car insurance, home insurance, MOT, etc) to factor in your new name. Luckily, marriage being so common, most banks and agencies are happy to do a lot of the work here on your behalf, but it’s still worth The boring part © stock.adobe.com/Emil 64 Á LEGALITIES 62www.hopkins-solicitors.co.uk Sutton, Kirkby, Mansfield & Nottingham We love to help people M o r e t h a n ju s t Leg a l E x p e r t s HIGHLYRECOMMENDED > Pre-nuptial agreements making sure you are both protected > Conveyancing helping you buy your first home together > Will Writing ensuring your new family is protected This is one of the most exciting times in both your lives! How will you manage that if your passport no longer legally applies because you’re a different name now? Did you know that passports are one of the few legal documents that can be changed up to three months before your wedding? Probably not, but the idea is that you can apply for the change proactively to save you time. It won’t be valid before the date because there’s always the chance you call it off, but it’ll be active after and allow you to jet off without any problems. Of course, we no longer live in a society where women have to give anything up if they don’t want to and many choose to keep their maiden names, which is perfectly legal. There’s actually no extra work that needs to be done in this case as a marriage certificate does not automatically change your name. An increasingly popular option of late is combining last names, which lets both families continue on and joins them into a usually double-barrelled format. This will require twice the paperwork as both partners will need to update everything, but that is a nice bit of equality given it’s traditionally been the woman’s responsibility to give up their name. If you’re thinking of moving into a house after, or you’ve been living together already, then it’s also worth consulting a solicitor ahead of the wedding. It may not be exciting, and it may not be romantic, but your assets will change when you get married and being aware of that ahead of time can save a lot of heartache and worry. Similarly, a failure to look into the matter could cause problems down the line, not only in the unfortunate possibility of divorce, but also an unexpected death or with inheritance to members of your spouse’s family. It’s best to be prepared and speak to someone about the law, rather than to skip over it because it’s boring.
